ARTICLE 1 - SCOPE OF APPLICATION
These general terms and conditions of sale (hereinafter "GTC") apply to all orders placed by private individuals and professionals directly on the websites of B&B Labels SARL. Stickerkid is a brand owned by B&B Labels SARL.
These terms and conditions may be modified at any time by Stickerkid. It is the customer's responsibility to consult and accept them before placing an order.
The applicable GTC are those appearing on the Sites on the day of the order.
The customer may at any time request Stickerkid to transmit the GTC in force at the date of his order by writing to support@stickerkid.com.
By placing an order with Stickerkid, the customer declares that he/she has full civil rights. Minors or persons under guardianship must, prior to any purchase, provide written authorization from their legal representative or guardian before placing an order.
ARTICLE 2 - ORDERING
It is possible to place an online order on the store pages.
If you are ordering as a private individual, please only use your private address.
If you are ordering as a company, please use a valid business address.
Once the customer has placed the products in his shopping cart, he verifies and checks the contents of his shopping cart (identification, quantity of products selected, corresponding prices, delivery methods and costs) before finally confirming it and accepting the payment obligation for the order via his choice of payment method.
Once the order has been completed, Stickerkid will confirm receipt of the order by sending the customer an e-mail confirming the order.
Stickerkid reserves the right to refuse the customer's order for any legitimate reason, in particular if one of the customer's previous orders has not been paid in full, or if a dispute concerning the payment of a previous order is being processed, or if several serious and concordant elements give rise to a suspicion of fraud in relation to the order, or if the requested personalization is considered unethical (see Article 8).
As the order confirmation email will be sent to the email address provided when placing the order, Stickerkid recommends that the customer contact our customer service by writing to support@stickerkid.com if the customer does not receive an email.
The production of the order starts at the moment the payment is confirmed by our bank. The order automatically goes to print in the order of confirmation and can no longer be changed.

ARTICLE 3 - DELIVERY
Our products are manufactured in our workshops in Switzerland or France and shipped from those countries.
Shipments are collected once per day on working days from Monday to Friday. If a shipment is packed and scanned after the collection time, it will be dispatched with the next available collection.
During the ordering process and depending on the destination, an estimated delivery timeframe is indicated to the customer for information purposes only. Delivery timeframes communicated on the website, during checkout, or in confirmation emails are estimates only and do not constitute a binding delivery commitment. They depend in particular on the destination country, the shipping method selected, any customs procedures, and the carrier.
The ordered products are delivered by post or by an independent carrier, depending on the country of delivery and/or the customer's choice. The products are delivered to the delivery address provided by the customer during the ordering process.
The customer is invited to carefully check the order and delivery details entered, to provide them in full, and to correct them if necessary before finalising the order.
The customer receives a shipping confirmation email at the email address provided when placing the order. Where a tracked shipping method has been selected, that email may, depending on the transport service concerned, include a tracking link as well as the corresponding shipment number. Where an untracked shipping method has been selected, no tracking link, no detailed tracking information, and no tracking number can be provided.
By choosing an untracked shipping method, the customer expressly acknowledges and accepts that the shipment cannot be subject to individual tracking and that no detailed proof of transit, delivery, failed delivery, delay, blockage, or loss can be provided by Stickerkid.
For untracked shipments, Stickerkid shall not be held liable for delivery delays, losses, misrouting, delivery failures, absence of scans, lack of transport information, or any other non-performance or improper performance attributable to the carrier, the local postal operator, or any third party involved in the transport process. In such cases, Stickerkid's liability is excluded to the fullest extent permitted by law.
If the customer has not received the shipment within 2 to 3 weeks, the customer is requested to contact support@stickerkid.com. Stickerkid will review the situation to the extent possible and on the basis of the information available. For untracked shipments, the possibilities for investigation, localisation, and claims with the carrier are limited or, depending on the country, carrier, and shipping method selected, may not exist.
Stickerkid shall not be liable for any failure to perform or improper performance of the contract resulting from force majeure, an unforeseeable and unavoidable act of a third party, logistical disruption, customs or administrative measures, strike, flood, fire, or any other event reasonably beyond its control.
If an order is returned to Stickerkid due to an incorrect or incomplete address, Stickerkid reserves the right to charge new shipping costs if a new delivery is requested, and Stickerkid also reserves the right to charge the production costs and the actual shipping costs incurred if a refund is requested without re-shipment.
If the order is returned to Stickerkid, Stickerkid will contact the customer by email and verify with the customer the delivery address provided and the reasons for the return.
The customer is requested to respond within the indicated timeframe with the complete and valid address and, where necessary, all requested information, so that the reasons for the return can be clearly verified and re-delivery can be ensured.
After a period of one month, if the customer does not reply to our email in order to activate re-shipment with a complete and valid address, the order will be destroyed by Stickerkid. After this period, a refund is no longer possible.
It is the customer's responsibility, where applicable, to make the usual reservations before taking possession of the goods. Stickerkid reserves the right to ship the goods under the best possible conditions without incurring liability.
Before refusing acceptance of a shipment, it is strongly recommended that the customer immediately contact support@stickerkid.com by email with precise details. Further information on the procedure to be followed will then be provided.

ARTICLE 4- PRICES & CUSTOMS CLEARANCE
Prices and shipping costs are indicated in the currency selected by the customer on the website. Stickerkid reserves the right to change the prices of its products at any time and without notice. The prices and conditions stated at the time of ordering apply.
Our product offers and prices are valid as long as they are visible on the website and while stocks last. If a product is no longer available after the order has been placed, the customer will be informed by e-mail.
If the customer orders products to be delivered outside Switzerland, they may be subject to import duties and taxes. Depending on the type of order, customs clearance is handled by Stickerkid or by the customer:
- Either Stickerkid takes care of customs clearance: The amount is due at the time of ordering. Stickerkid is not responsible if the package is subject to a random check that incurs additional costs. These costs may be charged to the customer.
- Or Stickerkid does not take care of customs clearance: import duties and taxes are only levied when the package arrives at its destination. All customs clearance costs are the responsibility of the customer. Stickerkid has no influence on these costs. Customs regulations vary greatly from country to country, so the customer should contact the local customs authorities for more information.
- In some countries, customs clearance fees are clearly required. These are always charged directly by customs to the customer (importer). These customs clearance fees are always payable by the customer in the countries where they are charged for each shipment.
If a customer is asked directly by customs to pay import VAT again (which Stickerkid cannot foresee or control), the customer can email support@stickerkid.com with the current customs invoice and receipt for the additional fees paid to customs. Stickerkid will then check these costs and, in the event of double taxation, refund the VAT costs already paid to Stickerkid.
It is not advisable, not to accept or collect your order due to customs charges. This would result in returns and Stickerkid may charge the customer for any costs incurred as a result of these returns.
Stickerkid is not responsible for any delays in returns or any losses incurred as a result of these returns.

It is clearly indicated on the website during the ordering process whether Stickerkid takes care of customs clearance.

ARTICLE 5 - PAYMENT & DATA PROTECTION
Payment is made by Visa, Eurocard/Mastercard, Paypal or on account (only valid in Switzerland). Shipping costs are borne by the customer and are paid by the customer when placing the order.
Payment by credit card is made via a secure payment platform to ensure the security of purchases made on the Sites and to combat fraud. Payment card data is encrypted using the SSL (Secure Socket Layer) protocol. Only the credit card organization has knowledge of the details on the credit card. Stickerkid has no knowledge of this.
Payment on account (only possible in Switzerland) is made by a third party organization. The payment period begins immediately when the order is placed and is independent of the status of the order and not when the goods are received. This organization has its own payment rules. In the event of late payment, this organization will apply a surcharge to the payment. Stickerkid is not responsible for this surcharge.
Stickerkid stores the personal data of its customers solely for the purpose of order processing and to comply with the applicable accounting and tax regulations of the country in which the goods are manufactured and managed. No data is passed on to or stored by third parties.
ARTICLE 6 - RIGHT OF WITHDRAWAL & CANCELLATION
Stickerkid products fall under the category of "goods made to the consumer's specifications and clearly tailored to personal needs". In accordance with the statutory provisions, the right of withdrawal cannot be exercised for Stickerkid products, as these are products that have been customized according to the customer's wishes. This makes them not resalable for Stickerkid.
6.1 Exception for WhyNote (or non-personalisable) products:
Stickerkid grants a withdrawal period of 14 calendar days from delivery of non-personalised products only and undertakes to take them back, on condition that they are undamaged, unopened and still in their original packaging (control labels intact, not detached/ripped/cut, etc.).
Defective products will in all cases be replaced by a new, identical product, unless the product in question is no longer available, in which case a credit note or replacement item will be offered to the customer.
A return request is mandatory and must be sent by e-mail to support@stickerkid.com.
In all cases, the customer is responsible for return shipping costs.
ARTICLE 7 - LEGAL GUARANTEES & REFUNDS
In accordance with the provisions of the legal guarantee of conformity and hidden defects, we will refund or exchange defective products or products that do not correspond to the order.
Differences in color and font between the labels shown in brochures or on websites and the products delivered cannot be the subject of a complaint. Printing, design or writing errors (wrong color, wrong telephone number, etc.) are not grounds for complaint. Once the order has been confirmed, change requests can no longer be considered. Any changes will be charged to the customer (new printout or new order). It is the Customer's responsibility to check the content and personalization in their shopping cart (see article 2).
Stickerkid's liability is limited exclusively to the replacement or refund of the invoice amount for non-compliant products, to the exclusion of any claim for damages.
The products received must be checked and tested immediately upon receipt. Complaints will be considered within one month of receipt of the products. Complaints submitted after this period will not be considered.
To this end, the customer must send a photo of the non-compliant or defective product to support@stickerkid.com so that their complaint can be taken into account and provide a justification for the non-compliance found.
If necessary, the customer may be asked to return the product in the condition in which it was received, together with all its elements (accessories, instructions, etc.) and in packaging that allows it to be transported safely, to the address communicated by Customer Service. The cost of the return will be reimbursed on presentation of the relevant receipts.
ARTICLE 8 - PERSONALIZATION OF PRODUCTS & PICTURES
The customer guarantees that they hold the rights to the images they download as part of their order, either because they are the owner, or because they have been authorized by the owner. The customer also guarantees that he/she has obtained the authorization of the persons appearing on the image to distribute and reproduce this image.
The customer undertakes not to provide Stickerkid with any photos of any kind whose possession or trade is prohibited by applicable law, in particular :
- any picture or data that may disturb public order or offend morality (obscenity, pornography, etc.). In this case, Stickerkid reserves the right to refuse to fulfill such an order.
- any image or indication that could infringe the right to privacy, the right to intellectual property or other similar rights, in the absence of authorization from the holder of such rights. Stickerkid may refuse to execute an order to reproduce a picture/photo protected by intellectual property rights on any medium whatsoever, as such reproduction is prohibited and punishable under criminal law as counterfeiting. In any case, the user remains responsible for the content that he uploads as part of his order.
Stickerkid therefore reserves the right to refuse orders that do not comply with the General Terms and Conditions or certain ethical values to which it is committed.
ARTICLE 9 - LIABILITY
Stickerkid makes every effort to ensure the confidentiality and security of the Data that may be entered or transmitted via its Services, but cannot be held liable for any deterioration, loss or accidental "hacking" that may occur despite all the precautions taken. The customer indemnifies Stickerkid against any prosecution and any claim for damages resulting from the loss and/or hacking of data. Furthermore, its liability for any damage is limited to gross negligence.
Stickerkid declines all responsibility for the use and storage of its products by the customer.
ARTICLE 10 - TRANSFER OF OWNERSHIP & TRANSFER OF RISK
The transfer of risk - which includes the risk of loss as well as deterioration of the goods - passes to the Customer at the time of receipt of the goods.
If the Customer does not take possession of the goods, the transfer of risk passes to the Customer at the time the goods are returned to Stickerkid.
If the customer returns goods to Stickerkid, the customer bears the risk until Stickerkid receives the goods.
ARTICLE 11- JURISDICTION & APPLICABLE LAW
The applicable law is Swiss law and the courts of Sion (Switzerland) shall have jurisdiction to settle all disputes arising from our sales.
